Yes, it is ATF Rule 41F compliant and approved for use in all 50 states. Many states have a Rule Against Perpetuities that holds the lifespan of a trust to 21 years, but you can amend it before its 21st birthday using our service.

Any eligible person who is a US citizen can participate in a gun trust, unless:

  1. You’ve ever been convicted of certain misdemeanor offenses in any state (e.g., violence, drug-related, fraud, etc.).

  2. You’ve ever been convicted of a felony in any state.

  3. You’ve ever been convicted of illegal possession of marijuana in any state before or after legalization and your conviction was never overturned.

  4. You’ve ever purchased a NFA item that was red flagged.

  5. You’ve ever been declared incompetent, diagnosed with a psychiatric disorder, or prescribed psychiatric medication.

  6. You’ve ever failed a criminal background check.

Any person who is not a US citizen or who is not eligible at the time that ownership of the firearms is transferred cannot participate in a gun trust. If a person is not eligible, the trust may contain rules that remove them from the trust automatically. Otherwise, it could be illegal for them to take possession of the firearms.

You can put any type of firearm in a gun trust, NFA or non-NFA.

This might include:

Yes, the first time you apply with the gun trust, the ATF will require your fingerprints and a passport-size photo. This fee is separate from our gun trust fee and is paid directly to the fingerprinting/photo facility of your choice.

We will complete your ATF paperwork. We will also submit your application to the ATF. All you have to do is get your fingerprints and photo.

Yes, you can make changes or updates to the trust anytime you wish.

Yes. You will only be submitting the Memorandum of Contribution to the ATF with the current firearms only, no additional assignments.
